We want you to make the most of what we have to offer, and for this it is crucial that you clearly understand the Terms and Conditions that govern our relationship with you.

These Terms and Conditions, which we refer to as the “Agreement”, represent a legally binding agreement between Perspektiva 360 S.A.S., identified with NIT 900.802.014-1, incorporated under the laws of Colombia, and you: our “Client”. This applies whether you are acting on your own behalf or on behalf of an entity.

The purpose of these Terms and Conditions is to regulate your access and use of our website, as well as the subscription or contracting of our “Service”, which operates under the brand name Kuna 360. This reference also includes any other media, channel, mobile website or mobile application related or connected to Kuna 360 as a brand of Perspektiva 360 S.A.S.

Kuna 360 services are designed to offer you a digital and personalized solution to order, manage and access audiovisual projects. These terms apply to all specific features and functionalities of our service, as well as our recommendations, reviews, websites and user interfaces, along with all associated content and software.

By subscribing or contracting our services, you agree to the Terms and Conditions described here. If you do not agree with any part of these terms, you will not be able to use our service. However, we want you to know that we are here to help you in case of any doubt or question.

In the event that you fail to comply with these Terms and Conditions, the relationship between you and Perspektiva 360 S.A.S. will cease, except for any outstanding financial obligations resulting from services rendered, which you must settle before terminating our contractual relationship.

1. Service Description

At Kuna 360, we specialize in high quality Digital Creation and Video Editing, all with the convenience of a subscription.

Core Services: By subscribing, you will be able to order the creation and/or editing of a wide range of videos. We are here to make your visions come to life, as long as you order videos that can be created and/or edited exclusively using digital resources, such as specialized software, artificial intelligence and pre-recorded material.

Complementary Services: In addition to our core services, we offer Professional Production Services. This includes from the creative phase and logistical planning to audio and/or video recording in specific locations and/or in studio. However, it is important for you to know that these services are not included in your subscription and are currently only available in Colombia.

2. Scope of Service

2.1. Subscription plans

Our premier digital creation and/or video editing service has a variety of options for your subscription, all designed to help you achieve your goals. Our three types of plans are: Visionary, Media Expert and Executive Producer.

What you get with each plan:

  • Access to a basic or full team depending on the plan you choose.
  • Unlimited video orders.
  • Unlimited video editing.
  • Unlimited change requests.
  • A specific guarantee period depending on the plan.
  • Subscription available for one or more brands depending on the plan.

Specific details about the conditions and upgrades of each Plan will always be updated on our website. If you don’t find exactly what you need, we can set up a customized plan with you that fits your specific requirements.


2.2. Specialties

We have a wide range of Specialties to make your audiovisual projects a reality, covering all your creative needs. Our Specialties include, but are not limited to:

  • Video brief generation.
  • Co-creation and scripting.
  • Review and selection of audiovisual material.
  • Layout.
  • Color correction and colorization.
  • Music and sound design.
  • Custom design and motion graphics.
  • VFX visual effects and 3D animation design.
  • Video optimization and multi-format adaptations.
  • Translation and subtitling.

It is important to note that our team of experts has the authority to determine how to apply each of these Specialties in your videos, always guaranteeing quality and taking into account your objectives. This flexibility allows us to adapt to your needs, especially when time is a crucial factor.

2.3. Scope of Complementary Services

Our range of Complementary Professional Production Services include, but are not limited to:

  • Production and logistics.
  • Audiovisual production.
  • Artists and talents.
  • Lighting.
  • Make-up.
  • Professional voice-over.

It is important to keep in mind that each audiovisual project is unique, so the terms and conditions of these Complementary Services will be designed specifically to meet your needs. We will work with you to create a customized offer that perfectly suits your video requirements.

2.4. Cloud services

All our services are requested and managed through our web application. This allows you to place an order from the formulation of the brief, the loading of the necessary inputs, follow-ups, comments and downloads, all in one place. With this platform, we simplify the production time of your videos.

Our application offers you a series of tools designed to make the management of your orders and videos as comfortable as possible. With it you will enjoy:

  • Intelligent online catalog: Easily access all your projects and files from anywhere and at any time.
  • Storage and access to editable files: Keep your resources organized and always available for what you need.
  • Video storage: We store your videos securely on our platform so you can access them whenever you need them.

3. Use of the Service

To start enjoying all that we have to offer, these are the steps we will follow:

  1. Subscription: To access our services, you need to subscribe. You can choose the plan that best suits your needs on our website.
  2. Payment confirmation: Once you have selected and confirmed your subscription plan, we will proceed with the corresponding payment.
  3. Account creation: Once payment is confirmed, an account will be created for you in our web application. Your login credentials will be sent to your email so you can access it.

With your credentials in hand, you will be able to start enjoying our services.

3.1. Video Orders

With an active subscription, you will be able to place all the Video Orders you want through our web application or our online customer service channels, where we will guide you step by step to deliver the necessary information and supplies and manage the entire process easily.

We are committed to make our best efforts to deliver your Video Orders with guaranteed satisfaction and quality, within the deadlines and delivery conditions stipulated for each plan. However, it is important that, as a Client, you provide all the necessary information and resources in a timely manner to ensure a successful production. Your assigned project manager will be there to help you every step of the way to ensure that your needs are met.

In certain situations, your project manager may need to take steps to ensure the efficiency of the process. This may include temporarily suspending or queuing Video Orders, particularly in the following cases:

  1. when the Order lacks the necessary information to ensure production to our quality standards.
  2. When the maximum limit of videos that can be produced simultaneously according to your plan has been reached.

Although we strive to adapt to your needs and priorities, it is important to keep in mind that our production volume depends on several factors, and we recommend that you avoid urgent requests.

Our customer service team is available during business days and hours in Colombia:

  • Monday through Friday, from 8:00 a.m. to 6:00 p.m. local time.

The delivery time of your Order will start from the moment you are notified that it has been accepted.

3.2 Video Production and Modifications

We are committed to turn your ideas into spectacular videos. All Production and Modifications during this process will be carried out as long as you have an active subscription to the service.

Our Production process runs on a first-come, first-served basis and begins with script development, when scripts are not included in the order. You will be able to review and approve or comment on each script directly on our web application.

Once you have approved the scripts, our team will begin Video Production. During this process, we will provide you with previews so you can review and request any changes you wish in terms of editing, style, graphics, text, music and other resources used. It is important to note that these previews do not constitute a formal delivery of the final video, but an opportunity to make sure that the final result meets your expectations.

Any modification request you send us will be considered approved by you for execution.

It is possible that some modifications may be related to our complementary Professional Production services and may incur an additional cost. In such cases, we will inform you in advance and provide you with a consultation for your approval.

Once the project is finished, you will be able to download your videos in high quality and optimized for the web immediately.

3.3. Turnaround Conditions

We ensure that you receive your videos in a timely and efficient manner. In order to access our Turnarounds you must have an active subscription.

Our turnaround process is simple and organized: videos are delivered one or two at a time, following the deadlines established for each plan and in order of order of order acceptance or priority that you have indicated. This ensures that each project is handled effectively and that you receive your videos on time.

To ensure that you will be completely satisfied with the final turnaround, you will have the opportunity to request additional changes within a later guarantee period depending on your plan. This guarantee is independent of activity on your subscription and is subject to the corresponding terms and conditions.

It is important to note that after a maximum of 90 days with no activity or modifications to a delivered order, we reserve the right to delete the files, media and related assets associated with each order from both our servers and offsite storage. This helps us keep our systems organized and efficient for future projects.

3.4. Warranty Conditions

At Kuna 360, we want to make sure that you are completely satisfied with the final result of your project. That’s why we offer a guarantee period with your subscription that allows you to request adjustments, changes or modifications to the final version of your videos, as long as they are related to the original video.

Any modification that alters the initial brief, idea or script can be considered as an additional work or a new video. In such cases, it will be necessary to have an active subscription to process these changes.

3.5. Acceptable Use

By using our services, you agree to do so in an ethical and legal manner. This means that we do not tolerate misuse, which includes soliciting illegal content, adult/pornographic content and/or violating copyrights and intellectual property of either Perspektiva 360 S.A.S. or third parties.

If we detect that you are using our services in a manner that is not aligned with our core values or that constitutes abuse of our services or equipment in any way, we reserve the right to suspend service to you.

Our goal is to maintain a safe and respectful environment for our entire community of interest. We appreciate your cooperation in helping us achieve this goal.

4. Intellectual Property

We value and respect intellectual property in all its forms. We want to make sure you understand your rights and responsibilities with respect to content generated and shared through our services.

All audiovisual content provided on our website, official channels or through our services is protected by copyright and other intellectual property laws. These rights belong to Perspektiva 360 S.A.S. and its associated brands, as well as other licensed parties.

When you share user-generated content through our services, you grant us a worldwide, non-exclusive, perpetual, royalty-free, sublicensable license to use it in a variety of ways, such as modifying, adapting, publishing, distributing, and displaying it. However, we acknowledge that the videos you request and receive are your property and you retain full ownership of them.

It is important to note that we may use the audiovisual pieces created for you in our marketing and promotional strategies. To do so, we request your consent to publish your work in our portfolio, website, social networks, email and other communication channels. If at any time you wish to revoke this consent, you can notify our team in writing through our official digital channels.

We are committed to maintaining archival copies of your content for as long as necessary to fulfill your orders. However, we reserve the right to delete these copies after 90 days, both from our servers and from external storage, as set forth in these Terms and Conditions.

5. Subscriptions, Payments and Cancellations

5.1. Subscriptions and Fees

When you sign up, you agree to pay the corresponding fee according to the plan you choose. Our plans may be monthly, semi-annual, annual or include special offers.

Your subscription will have a fixed duration according to the plan selected and will be automatically renewed at the end of each period, unless you request a change of plan, a pause or the cancellation of your subscription. We are committed to informing you in advance of any changes to the standard rates, but we will not give advance notice for temporary promotions or rate reductions.

As a customer, you are responsible for using Kuna 360 services after payment. We are here to help you every step of the way.

5.2. Payment Methods

To subscribe or sign up for any service, you must provide one or more Payment Methods. You authorize us to charge through the primary Payment Method associated with your account, such as credit card, bank transfer or PayPal. In the event that the primary Payment Method is declined or unavailable, you authorize us to charge through any other Payment Method you have provided.

It is important that you keep your payment information up to date to avoid service interruptions. This includes ensuring that your credit card information is current and that your account has sufficient funds for scheduled payments.

In the event that a payment is not successfully settled due to expiration, insufficient funds or other reason, and you have not paused or cancelled your subscription, we reserve the right to temporarily suspend your access to the service until we have successfully collected and have a valid Payment Method at our disposal.

5.3. Pause and Unsubscribe

At Kuna 360, we understand that circumstances may arise that require adjustments to your subscription. Therefore, we offer you the option to pause or cancel your subscription at any time.

To avoid additional charges, we recommend that you request a pause or cancellation prior to your subscription renewal date. This will ensure that you can make the necessary changes without hassle. To request cancellation of your subscription, simply contact us through our official digital channels and we will be happy to assist you.

It is important to note that after the pause or cancellation of your subscription, you will continue to have access to all Kuna 360 services and your files until the end of the paid billing or warranty coverage period. However, after the end of these periods, paused accounts will retain access to their files, while cancelled accounts will lose access to both the service and their files.

5.4. Refunds and Returns

Payments made are non-refundable, and we do not provide refunds or credits for any partial subscription period. However, your satisfaction is fundamental to us, and you have an expert team and guarantees during and after the final delivery of your videos to request any changes you desire.

We will be willing to consider a refund only in specific cases that meet any of the following conditions:

  1. Breach of terms and conditions by the Kuna 360 team.
  2. Inability to provide the service due to causes under the control of the Kuna 360 team.

If you believe you meet any of these conditions and wish to request a refund, please do not hesitate to contact us through our official digital channels. We will be here to help you and resolve any concerns you may have.


6. Limitation of Liability

We strive to offer you high-quality and professional service in every project we undertake. However, it is important that you understand that while we strive to produce professional and optimally quality videos for publication and dissemination, we cannot guarantee results beyond this objective.

By using our services, you acknowledge and agree that you do so at your own discretion and risk. Although we strive to minimize any errors, due to the nature of creative work, some errors may occur in the delivered videos. At the time of delivery, we invite you to review all the delivered content to detect errors or omissions and notify our team if any changes or corrections are needed. We will be happy to expedite the necessary edits to correct any detected errors.

It is important to note that, as a client, you are responsible for the use of all products we deliver to you. To the fullest extent permitted by Colombian law, under no circumstances will Perspektiva 360 S.A.S. be liable to you or any third party for direct, indirect, incidental, special, or consequential losses or damages resulting from the use of our services, as well as the videos or other material and/or content produced by our team under the Kuna 360 brand. This also extends to any harm arising from or related to these terms.

It is important to note that some jurisdictions may not allow limitations on implied warranties or limitations of liability for consequential or incidental damages. In such cases, these limitations may not apply to you. However, in no event shall the total liability of Perspektiva 360 S.A.S. under this agreement exceed fifty dollars ($50), regardless of the cause of action, whether in tort, contract, or otherwise.

7. Changes of the Terms

Perspektiva 360 S.A.S. reserves the right to modify these terms at any time, with changes taking effect immediately upon posting. It is your responsibility to periodically review these terms to stay informed of any updates. If you do not agree with the terms of any modification, you have the option to cancel your subscription to our services.

8. Governing Law

At Kuna 360, we operate under the legal framework of the Republic of Colombia. Therefore, these terms and conditions are governed by the laws of this country. Any disputes arising in connection with these terms will be subject to the exclusive jurisdiction of the Colombian courts.
